Crapo, Risch say they'll vote against Sotomayor

July 27, 2009, 11:54 am

Idaho Republican Sens. Mike Crapo and Jim Risch say they intend to vote against President Obama’s Supreme Court nominee Sonia Sotomayor, according to an Associated Press report.

Crapo and Risch will join most Republican senators who have come out in recent weeks against Sotomayor, seeking to become the nation’s first Hispanic justice.

The Senate Judiciary Committee is expected to vote on her confirmation Tuesday.

Crapo and Risch, a former prosecutor, say they have too many concerns about the nominee’s views on the constitutional right to bear arms.

Crapo’s doubts stem from Sotomayor’s comments in a lower court case on whether the 2nd Amendment is binding on states. Crapo and Risch focused on her comment in the case stating the 2nd Amendment is not a “fundamental” right.

Risch says he is also bothered by Sotomayor’s willingness to use foreign law in considering legal cases.
